Throughout the Site, the terms “we,” “us,” and “our” refer to Simona Baibachaev Wellness / 13826139 Canada Inc., operating SimonaBaib.com and related online services, including coaching, educational content, digital products, and wellness-related resources.

 

2. Personal Information We Collect

 

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or content that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information.” We collect Device Information using the following technologies:

 

  • Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

  • Log files” track actions occurring on the Site and collect data, including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

  • Pixels,” “tags,” and “scripts” may be used to record information about how you browse the Site, support analytics, and assist with advertising and performance tracking (including tools such as Google Analytics, Google Tag Manager, Meta Pixel, TikTok Pixel, and Wix analytics).

 

Additionally, when you make a purchase, book a service, or attempt to make a purchase or booking through the Site, we collect certain information from you, including your name, billing address, email address, phone number, and payment-related details (processed via secure third-party processors such as Stripe, PayPal, or Wix Payments). We refer to this information as “Order Information.”

 

Because we provide health, nutrition, and wellness-related services, we may also collect information that you voluntarily provide through intake forms, questionnaires, coaching sessions, assessments, or lab-related services. This may include, but is not limited to:

  • Health history and symptoms

  • Diet and lifestyle information

  • Supplement and medication history

  • Lab test information and results (e.g., functional testing, hormone testing, digestive testing, as applicable)

  • Emotional and nervous system concerns, wellness goals, and related information

 

We refer to this category as “Health Information.” Health Information is collected only with your consent and is handled with heightened confidentiality in secure platforms such as Practice Better, Fullscript, Evexia, Nutri-Q, and Google Workspace.

 

When we talk about “Personal Information” in this Privacy Policy, we are referring collectively to Device Information, Order Information, and Health Information, as applicable.

 

3. How We Use Your Personal Information

 

We use the Order Information that we collect generally to fulfill any orders or bookings placed through the Site (including processing your payment information, providing you with invoices and/or order confirmations, delivering digital products, and managing access to courses, memberships, or programs). Additionally, we use Order Information to:

  • Communicate with you regarding purchases, bookings, or account-related matters;

  • Screen orders or bookings for potential risk or fraud; and

  • When in line with the preferences you have shared with us, provide you with information, education, or marketing relating to our products or services.

 

We use the Health Information you provide to:

 

  • Deliver wellness, nutrition, coaching, and nervous system support services;

  • Review assessment forms, questionnaires, and lab data where applicable;

  • Develop and adjust protocols, recommendations, and educational support;

  • Maintain appropriate records for continuity of care and as required by law.

 

Health Information is stored and accessed only as reasonably necessary to provide services, comply with professional and legal obligations, and operate our practice safely. We are not a HIPAA-covered entity; however, we endeavour to use platforms designed to meet high privacy and security standards (including PIPEDA and PHIPA-aligned practices for Canadian clients, and HIPAA-aligned infrastructure for U.S.-based tools where applicable). We use Device Information that we collect to help us:

 

  • Screen for potential risk and fraud (in particular, your IP address);

  • Improve and optimize our Site (for example, by generating analytics about how our visitors browse and interact with the Site);

  • Assess the success of our marketing and advertising campaigns;

  • Support security and performance monitoring.

 

We may also use Personal Information for:

  • Responding to inquiries or support requests;

  • Managing email subscriptions, newsletters, and opt-ins;

  • Administering promotions, events, waitlists, and launches;

We may occasionally use AI tools internally to help identify gaps, generate educational content, or support research; however, all recommendations are reviewed and finalized by a human practitioner, and we do not provide automated medical diagnoses. Identifiable Health Information is not shared with AI tools without clear consent and appropriate safeguards.

 

4. Sharing Your Personal Information

 

We share your Personal Information with trusted third parties who assist us in operating our business, delivering our services, and supporting the functionality of the Site. This includes service providers that help with activities such as website hosting, secure file storage, client communication, payment processing, email delivery, analytics, and customer support. For example, we may use a secure cloud-based system such as Google Workspace to store documents or communicate with clients.

 

These third parties have access to Personal Information only to perform tasks on our behalf and are obligated not to disclose or use it for other purposes, in accordance with their own privacy policies and applicable law. 

 

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights, safety, or the rights and safety of others.

 

We do not sell, rent, or trade your Personal Information.

 

5. SMS/ Text Message Data Collection & Use

 

In addition to the uses described above, when you opt in to receive SMS or text message communications from us, we collect and use your phone number and related opt-in information solely for the purpose of sending you updates, reminders, or promotional messages about our products and services, in accordance with your preferences.

 

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; that information will not be shared with any third parties. We may use subcontractors for support services (such as customer service or technical support), but not for promotional purposes.

 

Standard message and data rates may apply depending on your mobile carrier and plan.

We are not responsible for delays or failures in message delivery, as transmission depends on your mobile carrier and network availability. If you do not agree to these terms, please do not subscribe to SMS services or opt out promptly.

 

6. Data Retention

 

We retain Personal Information only for as long as necessary to fulfill the purposes for which it was collected and to meet our legal, regulatory, and professional obligations. Under PIPEDA, Personal Information must be destroyed, erased, or anonymized once it is no longer required for its intended purpose. However, certain records must be retained for minimum periods under Canadian law.

 

For client and service-related records, including Order Information and Health Information, we generally retain information for a minimum of seven (7) years after your last interaction with us, as required by the Canada Revenue Agency (CRA) and applicable provincial and professional guidelines. We may retain records longer if necessary to comply with legal obligations, resolve disputes, or maintain accurate business and financial documentation.

 

For marketing and general contact information, we may continue to store your information even after you unsubscribe from emails or SMS communications. Unsubscribing removes you from active marketing messages, but it does not delete your information from our systems. If you wish to have your information removed entirely from our marketing databases, you must submit a deletion request to privacy@simonabaib.com.

 

Please note that we may be required to retain certain information even after a deletion request if it is needed for legal, tax, fraud-prevention, recordkeeping, or other legitimate business purposes.

 

7. Changes

 

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices, changes in applicable laws, or for operational, legal, or regulatory reasons. If we make material changes, we will update the “valid as of” date at the top of this page. We encourage you to review this Policy periodically to stay informed about how we protect your Personal Information.

 

8. Children’s Privacy

 

Our services are intended for adults 18+. We do not knowingly collect information, online or offline, from minors without parental consent. If you are under 18 years of age, you may use simonabaib.com only with a parent or guardian.
